Civil law
Civil law, or generally referred to as private law, regulates the general legal relationships between different legal subjects. Alongside criminal law, which serves to protect against criminal offences, it is probably the most extensive area of law in Germany and, generally speaking, is intended to protect citizens in their normal actions. Everyone knows the most common applications. Normal shopping in a shop, hiring a tradesman, car repairs in a garage, disagreements with neighbours, the sale of a property or even a birthday present - all of these are legally covered by civil law. The relevant legal provisions in Germany are summarised in the German Civil Code (BGB). It sets out how you can defend yourself in the event of problems and how warranty and liability claims can be enforced.
If you want to describe civil law in more detail, the term "contract" is of crucial importance. No matter how informally or carelessly expressed, practically everything that we negotiate and agree among ourselves today can be traced back to a contract, to an offer and its acceptance.

The most common issues in civil law are, of course, purchase or rental agreements, as this ultimately affects almost everyone. If the desired product does not have the promised characteristics, if the new rented flat has obvious defects or even if it is a question of clarifying who is to blame for a road accident, then you can defend yourself with the means of civil law and try to get your rights. Whether it is then a question of cancelling a contract, obtaining compensation or a warranty or even claiming damages depends of course very much on the particular case and what you have set yourself as your goal.
The same also applies in the opposite case, of course. If you yourself are the seller of a good or service, it is essential to use your rights to collect claims. Without this, commercial activity is hardly possible. Claims for damages from customers can then quickly become economically problematic and threaten the continued existence of your own business. It is therefore essential for entrepreneurs to make the best possible use of their legal leeway when drafting and formulating contracts and general terms and conditions.
